Terms and Conditions
These Terms and Conditions apply to the purchase and commissioning of artworks, courses, private lessons, events, and other services provided by Hanne Gie, as well as the use of this website.
By completing an order or registration, the customer is considered to have accepted the Terms and Conditions applicable at the time of purchase.
Purchase of Artworks
Orders
Available artworks may be purchased or reserved through the website or by direct agreement. A purchase is considered confirmed once the order has been accepted and the customer has received confirmation or an invoice.
Original artworks are unique, and availability may therefore change. If an artwork is no longer available after an enquiry or order has been submitted, the customer will be informed.
Prices and Payment
The applicable price will be stated on the website, in a quotation, or through direct agreement.
Payment is made by invoice or through an available payment solution unless otherwise agreed. Payment deadlines and other relevant payment information will be stated on the invoice or order confirmation.
Artworks will normally not be shipped or handed over until full payment has been received, unless otherwise agreed in writing.
Delivery and Shipping
Delivery arrangements are agreed upon in connection with the purchase. Where applicable, artworks may be shipped or collected by prior agreement.
Any costs related to shipping, packaging, and insurance will be communicated or agreed upon before dispatch.
Customers should inspect the packaging and artwork as soon as the delivery is received. Any visible damage caused during transport should be documented with photographs and reported as soon as possible.
Responsibility for damage, loss, and delivery is governed by applicable law and the agreed method of delivery.
Right of Withdrawal and Returns
Any statutory right of withdrawal when purchasing artwork is governed by applicable consumer legislation and may depend on how the purchase was made and the type of product ordered.
Where a statutory right of withdrawal applies, the customer will be provided with the necessary information.
Goods or artworks made according to the customer's specifications or that are clearly personalised may be exempt from the statutory right of withdrawal under applicable law.
This may include certain commissioned artworks created specifically for the customer.
Commissioned Artworks
Commission Agreement
When commissioning a custom artwork, details such as subject, size, materials, price, and any specific requirements will be agreed upon before work begins.
Any reference photographs or other materials supplied by the customer must be legally available for the intended use. The customer is responsible for ensuring that the necessary rights or permissions have been obtained for any material provided.
Artistic Interpretation
A commissioned artwork is an independent artistic work. Reference photographs, descriptions, and customer preferences serve as a basis for the work, but the finished artwork will be created according to the artist's own style and artistic expression.
Minor variations between the reference material and the completed artwork should therefore be expected.
Changes
Any requested changes should preferably be agreed upon before work begins.
Significant changes to the subject, size, composition, or other essential aspects of the commission after work has begun may result in additional costs or an adjusted delivery time.
Payment and Delivery
The price and payment terms will be agreed upon before work begins or stated as part of the order.
The completed artwork will only be shipped or handed over once the agreed payment has been received, unless otherwise agreed in writing.
Right of Withdrawal for Commissioned Artworks
Commissioned artworks made according to the customer's specifications or which are clearly personalised may be exempt from the ordinary statutory right of withdrawal under applicable legislation.
Copyright and Artworks
Purchasing an original artwork means purchasing the physical artwork. Copyright and other intellectual property rights are not automatically transferred to the buyer.
Copyright remains with the artist unless otherwise expressly agreed in writing.
The artwork may therefore not be reproduced, copied, used commercially, incorporated into products, or otherwise commercially exploited without prior permission.
The artist may retain the right to photograph and display the artwork as part of a portfolio, website, social media, exhibitions, or other documentation of the artistic practice unless otherwise agreed.
Courses and Private Lessons
Registration
Registration for courses or private lessons is binding once the booking has been completed, subject to any statutory rights available to the customer under applicable law.
The price, date, duration, location, and other practical information will be stated in the relevant booking or course description.
Private Lessons
Private lessons are adapted to the student's level, goals, and interests within the scope of the lesson booked.
Bookings and payments are made through the website where available. Customers are responsible for checking the date, time, and other relevant information before completing a booking.
Cancellation and Refunds
Applicable cancellation conditions will be stated as part of the relevant booking.
For events and lessons where a full refund is offered up to 24 hours before the scheduled start time, cancellation must be received within this deadline.
Cancellations made less than 24 hours before the scheduled start time will normally not be refunded unless otherwise agreed or required by applicable law.
If an error occurs in connection with a booking or payment, the customer may make contact so that the matter can be reviewed.
Late Arrival
If a participant arrives late for a private lesson or course, the session will normally not be extended beyond the originally scheduled end time. The reserved time begins at the agreed starting time.
Cancellation and Illness
If a course, private lesson, or event must be cancelled by the organiser, participants will be informed as soon as possible using the contact information provided.
If a service is cancelled by the organiser, the amount paid for the cancelled service will be refunded unless the customer and organiser agree on a replacement date.
If the instructor is unable to attend due to illness, participants may also be offered an alternative date where appropriate.
Changes to Courses and Events
Minor changes may be made to course content, teaching methods, materials, or practical arrangements where necessary.
Participants will be informed if significant changes affect the service they have booked.
Materials
The relevant course or event description will specify whether materials are included in the price.
Where materials are not included, participants are responsible for bringing or purchasing the necessary materials before the course or event begins.
Photography, Video and Marketing
Photographs and video recordings may be taken during courses, workshops, and events for documentation and marketing purposes.
Participants may request not to be photographed or filmed. Anyone who does not wish to appear in such material may inform the instructor in writing before the event or directly before photography or filming takes place.
Photography and publication involving children and young people will be handled with particular consideration for applicable requirements and necessary consent.
Responsibility During Courses and Events
Participants are expected to follow relevant information and safety instructions provided during courses, lessons, workshops, and events.
Personal belongings are brought at the participant's own responsibility.
Any liability for injury, damage, or loss will be assessed in accordance with applicable law. Nothing in these Terms and Conditions is intended to restrict statutory rights that cannot legally be waived.
Events and External Commissions
Separate terms may be agreed upon for private events, workshops, Paint & Sip events, corporate assignments, and other external commissions.
These may include specific conditions regarding price, number of participants, duration, materials, travel expenses, venue, cancellation deadlines, and payment terms.
Where a separate written agreement for a specific assignment conflicts with these general Terms and Conditions, the specific agreement will apply to that assignment.
Prices, Taxes and VAT
All prices are stated with the taxes and charges applicable to the relevant product or service in accordance with current regulations.
Any additional shipping costs, travel expenses, material costs, or other charges will be communicated before the order is completed or agreed separately with the customer.
Copyright and Use of Website Content
All original content displayed on this website, including artworks, photographs of artworks, illustrations, text, graphic elements, and other artistic material, is protected by copyright to the extent provided by applicable law.
Content may not be copied, reproduced, distributed, modified, or used commercially without prior written permission from the relevant rights holder.
Privacy
Personal information is processed in accordance with applicable data protection legislation and the website's Privacy Policy.
Information regarding the personal data collected, the purposes of processing, data retention, and individual rights is available on the website's Privacy Policy page.
Errors and Availability
Hanne Gie reserves the right to correct typographical errors, pricing errors, technical errors, and inaccurate information regarding the availability of artworks, courses, or services.
If an error affects an existing order, the customer will be contacted as soon as possible in order to resolve the matter.
Governing Law
Purchases and agreements are governed by Norwegian law. Nothing in these Terms and Conditions is intended to limit any mandatory consumer rights provided under Norwegian legislation.
Changes to These Terms and Conditions
These Terms and Conditions may be updated if services, prices, website functionality, or applicable regulations change.
The Terms and Conditions in effect at the time an order is completed will generally apply to that particular order.
