Image Usage License

This license applies to images of artworks, drawings, paintings, illustrations, photographs, and other visual material published on the Hanne Gie website and associated digital channels.

Copyright

All artworks, images of artworks, drawings, paintings, illustrations, and other original visual material are protected by copyright under applicable law unless otherwise expressly stated.

Copyright in the artworks belongs to Hanne Giertsen / Hanne Gie. The publication of an image on this website or on social media does not mean that the image or artwork is freely available for further use.

Purchase of Original Artwork

When an original artwork is purchased, ownership of the physical artwork is transferred to the buyer. Copyright and other intellectual property rights relating to the artwork are not automatically transferred.

Purchasing an artwork therefore does not grant the buyer the right to produce copies, prints, posters, digital reproductions, products, or other reproductions of the artwork for sale, marketing, or other commercial purposes.

Such use requires a separate written agreement.

Private and Non-Commercial Sharing

Buyers, course participants, and others may share photographs of artworks in private and non-commercial contexts, such as on personal social media accounts, provided that the use is not for commercial purposes.

When an artwork is shared publicly, the artist should be clearly credited as:

Where appropriate, a reference to the artist’s website or social media account may also be included.

Images should represent the artwork in a manner that does not significantly alter, distort, or misrepresent the original artistic expression.

Commercial Use

Images of artworks or other visual material may not be used commercially without prior written permission.

This includes, but is not limited to, use in:

  • Advertising and promotional campaigns
  • Marketing materials
  • Business and organisational websites
  • Commercial social media accounts
  • Products and merchandise
  • Posters and printed materials
  • Books and publications
  • Packaging
  • Digital products
  • Promotional campaigns
  • Commercial presentations
  • Resale or sublicensing to third parties

Commercial use may require a separate licensing agreement and licensing fee.

Press, Media and Editorial Use

Press organisations, media outlets, galleries, cultural institutions, and other organisations wishing to use images of artworks for editorial purposes are requested to obtain permission before publication unless permission or an agreement has already been provided.

For approved use, the artist’s name and any other required credit information must be clearly displayed.

Images must not be used in a way that creates a misleading impression regarding the artist’s work, statements, collaborations, endorsement, or association with a business or organisation.

Editing and Modification

Images of artworks may not be altered, manipulated, or modified in a way that significantly changes the original artistic expression without prior approval.

This includes significant changes to colour, composition, content, proportions, or other essential elements of the artwork.

Standard technical adjustments, such as moderate cropping or resizing for publication, should not alter or distort the artwork’s original expression.

Downloading and Reproduction

The availability of images on this website does not constitute permission to download them for further publication, copying, distribution, or reproduction.

Images may not be uploaded to image libraries, databases, digital archives, or other collections intended for further use or distribution without prior written permission.

Artificial Intelligence and Machine Learning

Artworks, images, drawings, and other visual material belonging to Hanne Gie may not, without explicit written permission, be used as material for the training, development, or fine-tuning of generative AI models or other machine-learning systems.

The material may also not be collected or used for the purpose of generating, imitating, or developing commercial material based on the artist’s works or visual style without the necessary permission.

NFTs, Digital Products and Resale

Artworks or images of artworks may not, without written permission, be used to create or sell NFTs, digital collectibles, digital products, or other forms of commercial digital distribution.

Commissioned Artworks

Copyright in commissioned artworks remains with the artist unless otherwise expressly agreed in writing.

The customer may own the physical artwork without acquiring the right to commercially reproduce, distribute, or otherwise commercially exploit the artwork.

If a commissioned artwork is intended for commercial use, including use as an illustration, branding, packaging, advertising, or marketing material, the relevant usage rights must be agreed separately.

Artist’s Use of Their Own Work

The artist generally retains the right to document and present their own artworks through portfolios, websites, social media, exhibitions, applications, publications, and other presentations of their artistic practice unless otherwise agreed in writing.

For private commissioned artworks, specific arrangements regarding publication and documentation may be agreed upon in advance.

Licensing

Businesses, galleries, cultural institutions, media organisations, publishers, and others wishing to use an artwork or image beyond the uses permitted under this policy may contact Hanne Gie to arrange a separate license.

A licensing agreement may specify:

  • Which images or artworks may be used
  • The purpose of the use
  • The media and platforms on which the material may appear
  • Geographic territory
  • Duration of the license
  • Credit requirements
  • Any exclusivity arrangements
  • Licensing fees

Copyright Infringement

Unauthorised copying, reproduction, distribution, commercial use, or other exploitation of artworks and visual material may constitute an infringement of the artist’s copyright.
